Frequently Asked Questions
Dealing with unexpected injuries is challenging and having to think about hiring an attorney and the process of seeking compensation can feel like added stress. As your attorneys, our goal is to help you throughout this entire process and fight for you to be fairly compensated so you can continue recovering from your injuries. We’re sure you’ll have many questions for us. So to help you prepare for your initial consultation, we’ve answered a few questions that you might have right now.
What if I can’t afford an attorney?
In many instances, having to hire an attorney can be overwhelming. Obtaining legal services from a qualified attorney is often expensive.
At CHASENBOSCOLO, we know that aside from the physical pain and emotional trauma that you’re dealing with, you’re likely already grappling with financial stress, too. Because of that, we offer a No Fee Guarantee for our legal services. You don’t have to break the bank for high-quality, skilled legal services. We provide those legal services to you without requiring any upfront fees or charges. You don’t have to pay us until we either win your case or settle your claim. When you’re compensated for your injuries, we’re compensated for our services.
How much money can I get?
The amount of money that you can get for your injuries depends on several factors. The extent of your injuries, the losses you’ve suffered as a result of your injuries, and any contribution you may have had for the accident or other cause of your injuries will all be taken into account.
To determine the amount of compensation that we believe you’re entitled to, your attorney will calculate the costs (or losses) that you’ve incurred as a result of your injuries. This includes the physical, emotional, and financial losses that you’ve suffered. You may be eligible to be compensated for the following losses:
- Costs of your medical bills for treatment of your injuries
- Income or wages you’ve lost due to your injuries
- Loss of your future earning ability because of your injuries
- Cost of replacing or repairing damage to your property caused by the accident
- Pain and suffering
- Permanent disability, scarring, or disfigurement
- Mental anguish
- Loss of enjoyment or quality of your life
- Loss of consortium (spouses can be compensated in a wrongful death lawsuit for the loss of their loved one)
You could also be awarded punitive damages if your case is litigated in court. Punitive damages are awarded to injured parties to deter the responsible party and others from repeating the behavior that resulted in your harm. However, this type of compensation is only awarded by a jury or judge if you can show, with clear and convincing evidence, that the person who caused your injuries did so with malice.
Another factor in how much you might be compensated for your injuries is whether you contributed to the accident or to the cause of your injuries. Because Maryland adheres to the pure contributory negligence doctrine, if you were in any way to blame for your injuries, you won’t be able to recover any compensation for your losses. Even if you were only one percent to blame for your injuries, you would still be barred from recovering compensation for your losses.
How long will it take for me to be compensated?
The time that it takes to pursue compensation for your injuries is difficult to predict. The process depends on how you were injured and who injured you.
If you were injured in an accident, such as a car accident or a slip and fall accident in many cases, you may have to file a personal injury claim with the at-fault party’s insurance company. Your attorney will negotiate with the insurance company for you to get the compensation you’re owed. This process can take a short time or it can take a while. It all depends on the success of the negotiations with the insurance company.
If the insurance company agrees to settle your claim quickly and compensate you fairly, your claim would be resolved at that point. However, sometimes insurance companies won’t agree to pay you for the full amount of your losses or they may deny your claim entirely. If that happens, you and your attorney could file a lawsuit against the responsible party to seek full compensation for your injuries. This process is even more unpredictable. Lawsuits are rarely resolved quickly, and court hearings and a trial can take months or years.
