Maryland Court of Appeals Rules in Favor of Redskins Players

In the case of Tupa v. Pro-Football, Inc., the lower courts in Maryland found that the state has jurisdiction over injuries suffered by Washington Redskins players while playing or practicing at FedEx Field—a finding confirmed by the Maryland Court of Appeals.
The courts also overruled the longstanding Rowe v. Baltimore Colts precedent. This case has been used since 1983 to deny professional athletes workers’ compensation benefits on the grounds that injuries were expected. The court cited that it is a “conspicuously wrong idea that football injuries should not be considered accidental because football is a dangerous sport fraught with expectation of injury.”

Football Players Take Workers’ Compensation Cases to Maryland Court

Several professional football players, including former Baltimore Raven, Darnerien McCants, have taken cases to the Maryland court system arguing that the NFL and its teams should be held accountable for paying workers’ compensation benefits. McCants’ lawyer, Benjamin Boscolo, argued that many of the games he played took place in Maryland, making the state the appropriate venue to receive benefits, despite the fact that his injuries occurred in another state. Each state’s rules differ regarding who can receive benefits and how much they can receive, which can leave many professional athletes questioning how to obtain the workers’ compensation benefits they deserve. Ben Boscolo Inducted Into College of Workers’ Compensation Lawyers

On March 10, 2012, Benjamin Boscolo was inducted into the College of Workers’ Compensation Lawyers in San Antonio, Texas. The college honors top attorneys who have distinguished themselves in the field of workers’ compensation. Inductees are selected for displaying outstanding traits developed over the course of their long careers, including a commitment to high professional and ethical standards.
Members of the college must maintain certain qualities in their practice, including acting as a model of professionalism for new attorneys, displaying civility in trials, demonstrating an active interest in resolving issues and continuously increasing knowledge in all areas of the law.
To become a member of the college, Benjamin took an oath swearing to commit himself to a lifelong dedication to the highest standards of professional conduct, integrity and respect for the legal process and its participants.
Lyn and Barry Chasen Fund Scholarship

Congratulations to the winners of the Lyn and Barry Chasen Fund scholarship at the University of Maryland College! This program provides scholarship assistance to seven individuals pursuing their educational dreams. This year’s recipients include an active duty officer in the U.S. Air Force, several stay-at-home moms and a husband and father of two sons, who will be the first person in his family to earn a college degree. Lyn and Barry are delighted their efforts enable people to pursue their dreams, provide for their families and improve the communities in which they live.
Operation Care Package 5k

CHASENBOSCOLO was a Silver sponsor for the Operation Care Package 5k, which raised $10,000 for supplies for soldiers serving overseas. Among other things, soldiers requested Hacky Sacks, character Band-Aids and Skittles to give to local kids. The District of Columbia Court of Appeals upheld an award of District of Columbia workers’ compensation benefits to a former minor league player in the Washington Capitals hockey organization, Jamie Huscroft (No. 08-AA-1476). The outcome of the case enables minor league professional athletes under two-way contracts to seek workers’ compensation benefits from the parent club.
